Bitcoin Holds Above 78000 as CFTC Floats CPO Exemption Proposal
Bitcoin traded at 78283.92 with a 2.6 percent advance on CoinGecko data at 1019 a.m. Eastern Time. Ethereum moved to 2486.15 for a 3.5 percent gain while Solana printed 94.76 after a 2.0 percent lift.
The CFTC approved a notice of proposed rulemaking on August 18 to restore Rule 4.13(a)(4) CPO registration relief for certain SEC-registered investment advisers whose privately offered pools stay limited to Eligible Participants. Sidley Austin reported the action on August 21. The proposal appeared in the Federal Register the same day under 91 FR 54264 and RIN 3038-AF78. Comments close on October 5 2026. This remains a proposal rather than a final exemption.
Proposal Scope
The measure would add a CPO exemption for RIAs that keep pools to Eligible Participants. It would also restore a matching CTA exemption under 4.14(a)(8)(i)(D) and lift the Small Pool Exemption cap in 4.13(a)(2) from 400000 to 800000. The 15 participants per pool limit stays unchanged. If adopted the rule would supersede staff Letters 25-50 and 26-06 yet Letter 25-50 continues as the interim standard until a final rule or public decision not to adopt.
Market Reaction
Majors continued to post green candles through the morning session even as the regulatory filing circulated. Bitcoin maintained its bid above the 78000 handle while altcoins such as XRP at 1.48 and Dogecoin at 0.09057 showed smaller positive moves. The chart action stayed orderly with no evident chop after the Federal Register notice.
