The Commission adopted its Policy Statement Concerning the Listing of Perpetual Contracts on May 29, 2026. On the same date the CFTC issued a separate order approving the KalshiEX LLC BTCPERP futures contract that references the bitcoin spot price. The order treated the contract as a DCM futures listing rather than a self-certified product under Regulation 40.2.
Perpetual contracts carry no fixed expiration date. A funding-rate payment between long and short positions replaces the usual convergence mechanism at expiry. The Commission directed that contracts outside the bitcoin order use the voluntary prior-approval route in Regulation 40.3 because each funding interval requires reliable cash-settlement data under DCM Core Principle 3.
Asset Classes Under Review
The policy flags agricultural products, precious metals, equity securities, and narrow-based security indexes for case-by-case 40.3 review. Agricultural perpetuals received particular caution because of seasonal supply swings that can challenge reference-price reliability. The statement itself is a general policy under 5 U.S.C. 553(b)(A) and does not amend the Commodity Exchange Act.
